States with conflicting status

In Rhode Island: Delta 8 THC is likely not legal according to Rhode Island state law. Rhode Island legalized all derivates, cannabinoids, and isomers of hemp, but Rhode Island has another law that defines Delta-8-THC under the definition of “THC,” which makes it illegal for human consumption. In Michigan: Delta 8 THC may be legal according to Michigan state law. Although the hemp law declares that all cannabinoids, isomers, and hemp derivatives are legal, the policies of Michigan’s controlled substances declares that Delta 8 is not legal, as an isomer and derivative.
